The military has flown spycraft over foreign nations, even quite often friendly ones, since WW II, in order to gather intelligence. Pre-emptive strikes on known terrorists may be necessary, but they should be done with Congressional oversight (albeit by necessity closed-door) and the approval of the country targeted, unless they are determined to be a "rogue nation."
